Why a Sovereign Wealth Fund in Mozambique?
With the discovery of vast natural gas reserves in Mozambique, there is great potential to transform the country through the revenues generated from the exploitation of these resources. Gas reserves could generate tens of billions of dollars in state revenue, providing a unique opportunity to increase investment in human and physical capital.
This transformation will only occur if revenues are spent rationally to benefit both current and future generations.
The establishment of a Sovereign Wealth Fund also recognizes these resources are highly volatile and can make Mozambique more vulnerable to external shocks. Good revenue management also requires the creation of an economic buffer to withstand these external economic shocks, to smooth out public spending over time and counteract the volatility of these revenues.
The main objective of the Mozambique Sovereign Fund is to help leverage the country's economic and social development by: (i) stabilizing the state budget in the event of volatile oil revenues; and (ii) accumulating savings for future generations by collecting revenues from oil and natural gas exploration and those resulting from the respective investments.
The Sovereign Wealth Fund: Revenues
Projections indicate annual gas exports could amount, in a scenario in which all the development projects approved by the government are in operation, to around USD 95.7 billion over the life cycle of the project.
Annual state revenues should not exceed USD 1 billion until the 2030s when the concessionaires have recovered their investment and started paying corporate income tax (IRPC). In the first years of production, state revenues will amount to just under 8 percent of total project revenues.
The FSM Law includes all the main sources of revenue from LNG projects and potential new oil discoveries, including (a) Petroleum Production Tax; (b) Corporate Income Tax, including that resulting from the taxation of capital gains; (c) Production Bonuses, and (d) Production Sharing from Profit Oil.
How will the revenues be managed?
A Transitory Account will be established as part of the Single Treasury Account, domiciled at the Central Bank, and will cover all LNG revenues and revenues from any new gas discoveries. The Transitional Account will ensure that the revenues are accounted for and managed transparently and that the correct shares of the revenues are directed to the FSM and the State Budget, respectively.
The State Budget will receive part of the revenues allocated to public spending that will be managed in accordance with the Budget approved each year by the Parliament.
During the first 15 years, 60 per cent of the projected revenues for a fiscal year will be allocated to the State Budget and 40 per cent to the SWF. This will make it possible to invest in the first period in improving public services and investing in infrastructure. After the 16th year the 50/50 split.
Allocations will be based on projections published in the Medium-Term Fiscal Scenario that informs budget preparations. The revenue projection methodology must ensure that allocations to the State Budget are smoothed over time to avoid pro-cyclicality in budget spending.
How will the revenues be managed?
A Transitory Account will be established as part of the TSA, domiciled at the Central Bank, and will cover all specific LNG revenue. The Transitory Account will ensure revenues are accounted for and managed transparently, and that the correct portions of revenue are directed to the SWF and the Budget.
Revenue to the Budget will be allocated to public spending and managed in accordance with the budget approved for each year by the Assembly of the Republic.
During the first 15 years, 60% of the projected revenue for that fiscal year will be allocated to the State Budget and the remaining 40% to the SWF. This split in the first period will enable the government in its effort to improve public services and invest in infrastructure. After the 16th year, the allocation will revert to a 50/50 split.
These allocations will be based on projections published in the MEF Medium Term Fiscal Scenario which informs budget preparation and development. The revenue projection methodology must ensure that allocations to the State Budget are smoothed over time to avoid pro-cyclicality in budget spending.
Are the Sovereign Wealth Fund's management, governance, transparency and accountability mechanisms in place?
The Santiago Principles[1] were applied in the design of the SWF and a clear division of responsibilities has been established.
The Assembly of the Republic enacted the legislation and oversees the management of the SWF; The Government determines the policies of the SWF within the framework of the SWF Law and oversees operational management, and the Bank of Mozambique (BM) is the operational manager of the SWF.
Prohibitions
The government is prohibited from entering into any contract, agreement or unilateral act that encumbers or imposes charges on the assets of the SWF. The SWF may not be used to: i) provide guarantees for the contracting of loans by the State or any other entities; ii) the payment of debts and debt servicing; or iii) the financing of political and party activities.
To diversify the SWF’s investments and ensure Mozambique does not become too dependent on the oil sector, the SWF is not authorized to invest in assets in the oil sector.
Transparency
The SWF will be managed transparently, with a significant amount of public information to be made available.
A monthly report will publish all amounts received and transfers made to and from the Transitional Account. The BM will be responsible for the quarterly investment reports and the MEF for the annual reports.
The Administrative Court will audit the government institutions involved in the management of the SWF, and the MEF will select an independent international auditor (through a public tender) to audit the accounts of the SWF and publish the audited financial statements.
The law also provides for two further bodies. A supervisory committee (that will include representatives of civil society, the business community, and other interested parties) to supervise the management of the SWF by the government and report quarterly to the Assembly on performance. The Investment Advisory Board (a board of 7 experts appointed by the government) must be consulted prior to making any decision on investment policy, the advice of the IAB will be public.

Porque um Fundo Soberano em Moçambique?
Com a descoberta de vastas reservas de gás natural em Moçambique, existe um grande potencial de transformar o país, por via das receitas que se vão gerar com a exploração deste recurso. As reservas de Gás podem gerar dezenas de mil milhões de dólares em receitas do Estado, proporcionando uma oportunidade ímpar para aumentar os investimentos em capital humano e físico.
Esta transformação só irá ocorrer se as receitas forem gastas de forma racional para beneficiar tanto as gerações actuais como as futuras gerações.
O estabelecimento de um Fundo Soberano prende-se também com o facto de estes recursos serem altamente voláteis podendo tornar Moçambique mais vulnerável a choques externos. Uma boa gestão das receitas também requer a criação de um amortecedor económico para resistir a estes choques económicos externos, para suavizar a despesa pública ao longo do tempo e contrariar a volatilidade destas receitas.
O Fundo soberano de Moçambique tem como objectivo principal contribuir para alavancar o desenvolvimento económico e social do País através da: (i) Estabilização do Orçamento do Estado, em casos de a volatilidade das receitas petrolíferas; e (ii) Acumulação de poupanças para as futuras gerações, através da colecta de receitas provenientes da exploração de petróleo e gás natural e as resultantes dos respectivos investimentos.
O Fundo Soberano: as receitas
As projecções indicam que as exportações anuais de gás poderão ascender, num cenário onde todos os projectos de desenvolvimento aprovados pelo Governo estejam em operação, cerca de 95,7 mil milhões de dólares (nominais) ao longo do ciclo de vida do projecto.
As receitas anuais do Estado não deverão exceder a mil milhões de dólares até na década de 2030, quando as Concessionárias tiverem recuperado o seu investimento e começarem a pagar o imposto sobre o rendimento de pessoas colectivas (IRPC). Nos primeiros anos de produção, as receitas do Estado ascenderão a pouco menos de 8% do total das receitas do projecto.
A Lei do FSM inclui todas as principais fontes de receitas dos projectos de GNL e potenciais novas descobertas de petróleo, incluindo: (a) Imposto sobre a Produção do Petróleo; (b) Imposto sobre o Rendimento das Pessoas Colectivas, incluindo o resultante da tributação de mais-valias; (c) Bónus de Produção; e (d) Partilha de produção a partir do Petróleo-Lucro.

Como serão geridas as receitas?
Uma Conta Transitória será estabelecida como parte da Conta Única do Tesouro, domiciliada no Banco Central, e abrangerá todas as receitas de GNL e receitas de quaisquer novas descobertas de gás. A Conta Transitória assegurará que as receitas sejam contabilizadas e geridas de forma transparente, e que as quotas correctas das receitas sejam dirigidas para o FSM e o Orçamento do Estado, respectivamente.
O Orçamento do Estado receberá a parte das receitas afectadas à despesa pública que serão geridas de acordo com o Orçamento aprovado cada ano pela Assembleia da Republica.
Durante os primeiros 15 anos, 60% das receitas projectadas para um ano fiscal serão alocadas para o Orçamento do Estado e 40% ao FSM. Isto permitirá realizar investimentos no primeiro período na melhoria dos serviços públicos e no investimento em infraestraturas.
As alocações serão baseadas em projecções publicadas no Cenário Fiscal ao Médio prazo que informa os preparativos orçamentais. A metodologia de projecção das receitas deve assegurar que as dotações para o Orçamento do Estado sejam suavizadas ao longo do tempo para evitar a pró-ciclicidade nas despesas orçamentais.
Os mecanismos de gestão, governação, transparência e prestação de contas do Fundo Soberano estão assegurados?
Os Princípios de Santiago foram aplicados na concepção do FSM e esta estabelece uma divisão clara de responsabilidades[1].
A Assembleia da República adopta a legislação e supervisiona a gestão do FSM; O Governo determina as políticas do FSM no âmbito da Lei do FSM e supervisiona a gestão operacional, e o Banco Central é o gestor operacional do FSM.
Das proibições
É proibido ao governo celebrar qualquer contrato, acordo ou acto unilateral que onere ou imponha encargos sobre os bens do FSM. O FSM não pode ser utilizado para: i) a concessão de garantias na contratação de empréstimos pelo Estado ou outras entidades; ii) pagamento de dívidas e serviço da dívida; ou iii) financiamento de actividades políticas e partidárias.
Para diversificar os investimentos e assegurar que Moçambique não se torne demasiado dependente do sector petrolífero, o FSM não está autorizado a investir em activos no sector petrolífero.
Transparência
O FSM será gerido de forma transparente, com disponibilização de informação pública.
Mensalmente, é publicado um relatório sobre todos os valores recebidos e transferências efectuados a partir para e da Conta Transitória. O BM será responsável pelos relatórios trimestrais de investimento e o MEF pelos relatórios anuais.
O Tribunal Administrativo irá auditar as instituições governamentais envolvidas na gestão do FSM, e o Ministério que superintende a área de economia e finanças através de um concurso públicos seleccionará um auditor internacional independente que procederá à auditoria das contas do FSM e divulgará as demonstrações financeiras auditadas.
A lei prevê igualmente dois outros órgãos. Um comité de supervisão que incluirá representantes da sociedade civil, comunidade empresarial e de outras partes interessadas para reportar a assembleia sobre o . Este comité apresentará trimestralmente ao Parlamento um relatório sobre as operações do fundo soberano. O Comité Consultivo para o Investimento (7 peritos nomeados pelo governo) têm de ser consultado antes da tomada de qualquer decisão em matéria de política de investimento; o parecer do Comité Consultivo para o Investimento será público.
